What personal data we collect and why we collect it

Comments

We keep all the information you provide us with for up to 3 months or 3 months from our last contact to / from you or from the date of your event (whichever is longer).  This information may be supplied through our Contact form, by email, by phone or in person.  At the end of that time any and all information supplied is deleted

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

With respect to any photographs taken by us during your event or your guests use of our services, you grant us a world-wide, royalty free and non-exclusive license to reproduce, modify, adapt and publish such photographs for the purpose of displaying, distributing and promoting the specific gallery to which such photographs were submitted, or for the purpose for which such photo or graphic was submitted to the services and to use these photographs for our own advertising and promotional purposes in connection with the services.

Contact forms

We keep all the information you provide us with in our Contact Form for up to 3 months or 3 months from our last contact to / from you or from the date of your event (whichever is longer).

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

Analytics

Who we share your data with

We may on occasion sub contract your event to another photo booth provider.  In that case we will share with them details of the event such that they can fulfill the event.  We post a limited number of data files from an event onto our Facebook page.  This post will include a link to a page on our web site which will contain all the data files (not including video recordings) from the event.  We do not otherwise share, sell or otherwise monetise your data.  We use an account on Dropbox to store the data files relevant to your event for up to a year after which all data is stored on an external hard drive.  This external hard drive is not connected to any other device except where we are transferring data to it.  We will prosecute any infringements of our copyright where ever it occurs.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognise and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data

Visitor comments may be checked through an automated spam detection service.  After an event we will send the data files from an event to the event organiser using the email address we have been provided.  These data files are not subsequently shared without their written (by letter) consent.

Additional information

How we protect your data

All data relating to an enquiry is held within our email package on a single computer connected to the internet.  That data is only accessed by our Information Protection Officer.  This computer is protected by Norton Security software which automatically updates without any user intervention.  Our booth butlers are given all relevant details prior to an event so that they can complete the event.  This data is returned to our Information Protection Officer after the event who destroys this data.

What data breach procedures we have in place

The protection and security of the personal data that we process is of paramount importance to us and we have developed data specific protocols for any breaches relating to the GDPR and the data protection laws.  We define a personal data breach as any incident of security, lack of controls, system or human failure, error or issue that leads to, or results in, the destruction, loss, alteration, unauthorised disclosure of, or access to, personal data that we hold.

In order to carry out our statutory duties, we carry out regular information audits to ensure that all personal data processed by us is adequately and accurately identified, assessed, classified and recorded. We carry out risk assessments that assess the scope and impact of any potential data breach; both on the processing activity and the data subject.

What third parties we receive data from

We do not subscribe to any subscription based service.

All equipment remains the property of THE Party Photobooth Ltd at all times.
By placing an order with us either verbally or via e-mail regardless of whether a booking form has been returned or deposit paid it is deemed that the customer has read, understood, fully agreed to and is bound by all our terms and conditions of hire.
In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfil our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
You must ensure, in advance, that the venue allows reasonable access for loading and suitable parking once the Equipment has been unloaded.

Our booth butlers

The Party Photobooth Company Limited Ltd will not tolerate any abuse or threatening behaviour to any of our staff or abuse of The Party Photobooth Company Limited equipment. We retain the right to terminate this contract immediately in cases where our staff feel they are being abused or threatened or The Party Photobooth Company Limited equipment is being, or is in danger of being, damaged due to the actions of any persons attending your event.  We welcome the use of the booth by guests of all ages, however for insurance reasons, under 16s must be accompanied and supervised by a responsible adult at all times.
We ask that all persons using the services refrain from taking any food, drink and/or sharp objects into the Photobooth.
To ensure we are able to maintain the highest standards of cleanliness and presentation of our equipment we request that you notify your Party Photobooth Company Limited butler of any instances of soiling, spillage or damage.  Wherever possible and reasonable to do so we will speak with you or the venue first to try to resolve the matter before any termination is enacted.

Prices, Deposit & Balance Payments

All hires are subject to a non-refundable booking fee of at least £100.
The balance to be paid in full and cleared 14 days prior to the event start date unless approved alternatives can be agreed.
Terms for approved account clients will be strictly 14 days from invoice date unless agreed in writing by the company.
Advertised prices are subject to change without prior notification.
The Party Photobooth Company Limited reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate.

Cancellations

Any cancelled order is subject to the following cancellation charges:-
Within 8 weeks prior to event 25% of amount paid
Within 6 weeks prior to event 50% of amount paid
Within 4 weeks prior to event 75% of amount paid
Within 3 weeks prior to event 100% of amount paid

If you are a consumer the above does not affect your statutory rights to a “cooling off” period under The Consumer Protection (Distance Selling) Regulations 2000.

Equipment

The Party Photobooth Company Limited reserves the right to substitute hired equipment with equipment of a similar type and value without notice in the event of previous damage or loss of booked equipment.
All sizes quoted are approximate.
All goods remain the property of The Party Photobooth Company Limited at all times.
The Party Photobooth Company Limited reserve the right to amend or alter any product specifications without prior notice.

Site Location, Facilities & Conduct

Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
You are responsible for ensuring we have access to the event venue and to appropriate facilities, including, without limit, by arranging, in good time and at your own expense, all permits, licenses or other permissions necessary to enable us to gain access to the venue and perform the services.
The Photobooth is designed for indoor use only.
We require a floor space of two metres by three metres which will be enough for the footprint of the Photobooth and allow space for people to gather around. This must be within two to three metres of a single standard electrical power socket.
The Photobooth can only be situated on a firm flat surface, so if your event is in a marquee or similar temporary structure, a suitable base will be required. Our standard price assumes clear access at ground floor level.

The Party Photo booth Company Limited reserve the right to refuse delivery if the venue or site is deemed to be unsuitable by our delivery personnel or if the client has failed to notify the company of any delivery obstructions such as stairs or excessive loading distances from our vehicle to the installation site. In such a case no refund will be given and the full hire fee will be due.
The client is responsible for ensuring that suitable security and crowd control measures are in place prior to start of event.

Liability & Insurance

The company’s liability insurance covers use of the equipment only whilst booked on ‘wet’ hire (supervised by a representative of the company).
The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.
The company accept no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

Photographs

Photographs taken whist using the service will be available to view, upload and/or purchase, via the gallery if available on our website and/or may be shared via Facebook and otherwise released into the public domain by you or any guest attending your event.
If you request that we upload/share photographs taken at your event to Facebook you are responsible for ensuring you and any other guests accessing the photographs abide by the Facebook Terms of Use which can be found at https://www.facebook.com/terms.php?ref=pf
